Terms of Service

Per Contract Agreement:

1. Scope of Work

1.3 All creative direction—including lighting, posing, editing, and image selection—is at PHOTOGRAPHER’s sole artistic discretion.

1.4 PHOTOGRAPHER will make every reasonable effort to ensure the final images are consistent with the style, quality, and aesthetic represented in the Dropdeadshy portfolio and social media. However, CLIENT understands and agrees that lighting conditions, weather, location, wardrobe, and subject cooperation can significantly influence the final outcome.

1.5 As a result, variations in color, tone, and artistic presentation are natural and do not constitute grounds for dissatisfaction, refund, or re-editing.

5. Work Product & Delivery

5.1 Final images will be delivered digitally via a private online gallery within two (2) weeks of the session date.

5.2 The gallery will remain active for ninety (90) days. CLIENT is strongly encouraged to download all images immediately upon delivery, as PHOTOGRAPHER does not guarantee long-term storage of image files.

5.3 After the 90-day period, PHOTOGRAPHER may permanently delete all session images from archives and drives at their sole discretion.

5.4 RAW or unedited images will not be released under any circumstance.

5.5 PHOTOGRAPHER retains full discretion over image selection, and CLIENT understands that PHOTOGRAPHER will choose all final delivered images based on artistic judgment and quality standards.

5.6 PHOTOGRAPHER does not alter or manipulate body shapes, add or remove persons via Photoshop, or make any changes that would misrepresent the authenticity of the capture.

5.7 Retouching will remain true to the subject, focusing only on minor blemish correction, skin tone balance, and overall image enhancement consistent with PHOTOGRAPHER’s established style.

6. Copyright & Usage

6.1 All images remain the exclusive copyright of PHOTOGRAPHER under U.S. Copyright Law (17 U.S.C. §101 et seq.).

6.2 CLIENT receives a non-exclusive, non-transferable license for personal use only (printing, sharing on personal social media, etc.).

6.3 CLIENT may not alter, sell, edit, apply filters, or use images for commercial purposes without PHOTOGRAPHER’s written consent.

6.4 PHOTOGRAPHER retains the right to use all images for portfolio, marketing, editorial, and promotional purposes, unless CLIENT requests privacy (see Section 7).
